YELLOJOBS MEMBER TERMS

These Job Seeker/ Referrer Terms (the "Member Terms") supplement the Yellojobs General Terms and Conditions (the "Agreement") that are posted on, and applicable to, the Yellojobs Site. All capitalized terms used in these Member Terms have the same meaning as stated in the Agreement, unless otherwise defined herein. Click here to see the Yellojobs General Terms and Conditions.


If You elect to register as a Job Seeker or Referrer on the Yellojobs Site, You must also abide by the terms and conditions of these Member Terms and, as stated in the Agreement, these Member Terms form part of that Agreement. Please review the following terms carefully.


Referrer Rights and Obligations.

The following terms solely relate to the Referrer.

We agree to provide You with the opportunity to refer Job Seekers for certain job vacancies ("Positions") posted by Employers through Job Ads made available on the Yellojobs Site. You acknowledge and agree that You will not refer Yourself as a Job Seeker.


While We make no guarantee as to the likelihood that the Services will result in a hiring, if any Employer hires a Job Seeker that You have referred (an "Engagement"), You will be eligible for the "Yello Reward" specified by the Employer in reference to the Job Ad. Payment of the Yello Reward is subject to: (i) the Job Seeker being retained by Employer for the period specified by Us as the retention period (the "Retention Period") and (ii) the Job Seeker not being specified as an "Excluded Job Seeker" by either the Employer or Us. "Excluded Job Seekers" shall include persons that were submitted to Us by another Job Seeker or referrer (including any other Yellojobs member) prior to Your submission or any persons previously entered into the specific Employer's database. You are responsible for the filing and payment of all taxes related to the Yello Rewards. To allow Yellojobs to comply with applicable taxing authority payment and reporting requirements, You agree to provide Us with information prior to Our issuing of a Yello Reward.


For purposes of referring Job Seeker's to Employer posted Engagements, You agree that You will not contact, whether directly, indirectly or via any third party, any Employer, other than through the Yellojobs Site. In order to ensure that our business model works fairly and in the interests of You, Employers, Job Seekers and ourselves, You will inform Us if You become aware of an attempt by any party to make use of the Yellojobs Site whilst circumventing, in whole or part, the Yello Rewards.


Job Seeker Rights and Obligations.

The following terms solely relate to the Job Seeker.

If You are interested in a Position that a Referrer recommends, We will ask You to provide Us, at Your own expense, all necessary information and materials about Yourself which are requested by us, in such format as required by us ("Job Seeker Information"), so that We may provide the Job Seeker Information to an Employer through the Yellojobs Site. The Job Seeker Information should enable the Employer and Referrer to help ascertain Your suitability for the Position. The Job Seeker Information required will include, but is not necessarily limited to, Your identity, experience, qualifications and training, and such other information which an Employer considers to be necessary. You hereby consent to the disclosure of any Job Seeker Information to any Employer to whom You have been, or have agreed to be, introduced for a Position.


In the event You are hired for a Position, You may be required to inform Yellojobs that an Engagement has occurred. In the event of an Engagement, We will pay a Yello Reward to the Referrer to reward them for making the referral. You will not have to pay any fee to Us, to the Employer, or to the Referrer; Our service is entirely free of charge to You.


You warrant that all Job Seeker Information and material provided under these Member Terms is complete, accurate and suitable to be used by Yellojobs for the intended purposes and do not infringe or violate any third party's intellectual property rights, including, without limitation, copyrights, trademarks, patents, confidential information, moral or privacy rights. You represent and warrant that: (i) You will inform the Referrer of any reason why You may be unsuitable for the Employer's requirements, or if it is detrimental to the interests of the Employer for You to take the Position; and (ii) the Job Seeker Information is complete and accurate in all respects.


You acknowledge that We do not verify the Job Seeker Information. We make no warranty as to suitability of any Engagement that the Referrer has suggested may be of interest to You; nor do We make any warranty as to the ability of any Referrer to propose a suitable job for You.
