The following terms and conditions (the "Terms") form a binding agreement between You and Yellojobs. These Terms apply to all users of this website. Please review the following Terms carefully. The terms "Yellojobs" or "Us" or "We" or "Our" refers to Yellojobs. The terms "You" or "Your" refers to you, the user or viewer of the Yellojobs Site.
BY USING OR VISITING THE YELLOJOBS SITE OR SUBMITTING CONTENT TO THE YELLOJOBS SITE, YOU SIGNIFY YOUR ASSENT TO THESE TERMS. BY REGISTERING FOR AND USING THE SERVICES PROVIDED VIA THE YELLOJOBS SITE, (THE "SERVICES") YOU AGREE (I) THAT YOU ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AND (II) ARE BOUND BY ALL TERMS AND CONDITIONS, POLICIES, AND GUIDELINES OF THE YELLOJOBS SITE, WHICH ARE INCORPORATED BY REFERENCE HEREIN. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY CEASE USE OF THE YELLOJOBS SITE.
In order to use the Yellojobs Site and Services, You may be requested to provide specific personal data to Us, as further described in the Privacy Policy. All uses of Your personal information will be treated according to Our Privacy Policy. Click here to review the Yellojobs Privacy Policy. By using the Yellojobs Site or Services, You are accepting the terms and conditions of Our Privacy Policy. If You object to having Your information used as described in the Privacy Policy, Your sole recourse is to discontinue using the Services.
We provide an online referral recruitment service by which You either (i) refer candidates ("Job Seekers") for job opportunities ("Referrer") and, provided certain conditions are met, get paid a referral fee ("Yello Reward"); or (ii) post job openings ("Job Ads") as an employer ("Employer"); fill job vacancies through these referrals and, provided certain conditions are met, pay a fee if the referral was successful ("Success Fee"); or (iii) submit Your resume to Employers for the purpose of filling a job vacancy ("Job Seeker"). We also provide feedback by way of a rating system ("the Rating System") about different activities of Employers and Referrers, which is awarded automatically by the system as per guidelines specified on the Yellojobs Site. In addition to these Terms, the relationships between Yellojobs and Employers and/or Yellojobs and Referrers and Job Seekers shall be governed by the terms and conditions of the agreements found here [YELLOJOBS EMPLOYER TERMS, YELLOJOBS MEMBER TERMS] that are hereby incorporated by reference.
We reserve the right to modify, suspend, or discontinue the Yellojobs Site and the Services with or without notice to You and We are not liable to You or any third party should We exercise Our right to modify the Yellojobs Site or Services. If You object to any such changes, Your sole recourse is to discontinue using the Yellojobs Site and the Services. Continued access and/or use of the Yellojobs Site and/or the Services following notice of any such changes shall indicate Your assent to and acceptance of such changes. We may make additional Services available to You in the future and such additional Services may be subject to different terms and conditions and/or prices. Yellojobs will make such additional terms known to You before You order such additional Services and Yellojobs acknowledges that You are under no obligation to purchase such additional Services. If You order such additional Services they shall be subject to such additional terms and conditions as specified at the time of purchase.
We may change these Terms from time to time. If You object to any such changes, Your sole recourse shall be to cease using the Yellojobs Site and Services. Continued access to and/or use of this Yellojobs Site and Services following notice of such modifications or changes shall indicate Your assent to and acceptance of the Terms including, but not limited to, all posted changes.
You acknowledge and agree that We, at Our sole discretion, may terminate Your use of the Yellojobs Site and/or the Services without prior notice, and remove and discard any User Content from the Services, for any reason, with or without prior notice, including, without limitation, if We believe that You have violated or acted inconsistently with these Terms or the Privacy Policy. You agree that We shall not be liable to You or any third party for termination of Your access to the Yellojobs Site and Services. You also may discontinue Your participation in and access to the Services at any time.
This Yellojobs Site may contain links to third party websites that are not owned or controlled by Yellojobs. Yellojobs has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, Yellojobs will not and cannot censor or edit the content of any third–party site. By using the Yellojobs Site, You expressly relieve Yellojobs from any and all liability arising from Your use of any third–party content. Accordingly, We encourage You to be aware when You leave the Yellojobs Site and to read the terms and conditions and privacy policy of each other website that You visit.
Yellojobs hereby grants You permission to use the Yellojobs Site as set forth in these Terms, provided that: (i) Your use of the Yellojobs Site as permitted is solely for Your personal and internal business use; (ii) You will not copy or distribute any part of the Yellojobs Site in any medium without Yellojobs' prior written authorization; (iii) You will not alter or modify any part of the Yellojobs Site other than as may be reasonably necessary to use the Yellojobs Site for its intended purpose; and (iv) You will otherwise comply with the terms and conditions of these Terms.
In order to access some features of the Yellojobs Site, You will have to create an account. Not all features are available to all registered users. Users may have different access rights to the features and services of the Yellojobs Site depending on the type of account, if an Employer or a Referrer. You may never use another's account without permission. When creating Your account, You must provide accurate and complete information, including Your real name. You are solely responsible for the activity that occurs on Your account, and You must keep Your account password secure. You must notify Yellojobs immediately of any breach of security or unauthorized use of Your account. Although Yellojobs will not be liable for Your losses caused by any unauthorized use of Your account, You may be liable for the losses of Yellojobs or others due to such unauthorized use.
You agree not to collect or harvest any personally identifiable information, including account names, from the Yellojobs Site, nor to use the communication systems provided by the Yellojobs Site for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the Yellojobs Site with respect to their User Content (defined below). You further agree not to conduct or promote any illegal activities while using the Yellojobs Site, nor will You upload, submit, or transmit any form of virus, worm, Trojan horse, or malicious code, or impersonate another user. You agree not to circumvent, disable or otherwise interfere with security–related features of the Yellojobs Site or features that prevent or restrict use or copying of any Content (as defined below), User Content or enforce limitations on use of the Yellojobs Site or the Content therein.

Content on the Yellojobs Site is provided to You AS IS for Your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. Yellojobs reserves all rights not expressly granted in and to the Yellojobs Site and the Content. You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein, including any use, copying, or distribution of User Content of third parties obtained through the Yellojobs Site for any commercial purposes. If You download or print a copy of the Content for personal use, You must retain all copyright and other proprietary notices contained therein. You agree not to circumvent, disable or otherwise interfere with security related features of the Yellojobs Site or features that prevent or restrict use or copying of any Content or enforce limitations on use of the Yellojobs Site or the Content therein.
The Yellojobs Site may now or in the future permit the submission of material or other communications submitted by You and other users ("User Content") and the hosting, sharing, and/or publishing of such User Content. You understand that whether or not such User Content are published, Yellojobs does not guarantee any confidentiality with respect to any submissions. If You elect to provide User Content, You will not: (i) submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless You are the owner of such rights or have permission from their rightful owner to submit the material to Us and to grant Yellojobs all of the license rights granted herein; (ii) publish falsehoods or misrepresentations; or (iii) submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate.
For clarity, You retain all of Your ownership rights in Your User Content. By providing User Content, You grant to Yellojobs and its licensees a worldwide, royalty–free, fully paid, perpetual, irrevocable, unrestricted, unconditional, exclusive license to use, reproduce, modify, publish, edit, adapt, create derivative works from, translate, distribute, perform, display and otherwise exploit such User Content in any form, media, or technology, whether now known or hereafter developed or discovered, and to license and sublicense such rights through multiple tiers of sublicenses. You also acknowledge and agree that Yellojobs is free to use any ideas, concepts, know–how or techniques that You provide for any purpose without any compensation to You. You acknowledge and agree that Yellojobs shall not be liable for any failure to store User Content on the Yellojobs Site at any time. In the event You no longer have access to any data stored on the Yellojobs Site, You hereby release Yellojobs from any and all liability resulting from Your inability to retrieve Your data at any time. You take sole and complete responsibility for User Content. Yellojobs has no obligation to publish, display or otherwise distribute any User Content, including Yours.
You understand and acknowledge that Yellow Jobs does not endorse any User Content or any feedback, opinion, recommendation, or advice expressed therein, and We expressly disclaim any and all liability in connection with User Content. You understand that when using the Yellojobs Site, You will be exposed to User Content from a variety of sources, and that Yellojobs is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Content. You further understand and acknowledge that You may be exposed to User Content that are inaccurate, offensive, indecent, or objectionable, and You agree to waive, and hereby do waive, any legal or equitable rights or remedies You have or may have against Yellojobs with respect thereto, and agree to indemnify and hold Yellojobs, its affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to Your use of the site.
YOU AGREE THAT YOUR USE OF THE YELLOJOBS SITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, YELLOJOBS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE WEBSITE AND YOUR USE THEREOF. YELLOJOBS MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SITE'S CONTENT OR THE CONTENT OF ANY SITES LINKED TO THIS YELLOJOBS SITE AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE YELLOJOBS WEBSITE. YELLOJOBS DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE YELLOJOBS WEBSITE OR ANY HYPERLINKED WEBSITE OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND YELLOJOBS WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD–PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.
IN NO EVENT SHALL YELLOJOBS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE YELLOJOBS WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
YOU SPECIFICALLY ACKNOWLEDGE THAT YELLOJOBS SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
The Yellojobs Site is controlled and offered by Yellojobs from its facilities in the United States of America. Yellojobs makes no representations that the Yellojobs Site is appropriate or available for use in other locations. Those who access or use the Yellojobs Site from other jurisdictions do so at their own volition and are responsible for compliance with local law.
You agree to defend, indemnify and hold harmless Yellojobs, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys' fees) arising from: (i) Your use of and access to the Yellojobs Site; (ii) Your violation of these Terms; (iii) Your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that any User Content caused damage to a third party. This defense and indemnification obligation will survive these Terms and Your use of the Yellojobs Site.
You affirm that You are at least 18 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms. The Yellojobs Site is not intended for children under 18. If You are under 18 years of age, then please do not use the Yellojobs Site.
You agree that: (i) the Yellojobs Site shall be deemed solely based in Delaware; and (ii) the Yellojobs Site shall be deemed a passive website that does not give rise to personal jurisdiction over Yellojobs, either specific or general, in jurisdictions other than Delaware. These Terms shall be governed by the internal substantive laws of the State of Delaware, without respect to its conflict of laws principles. Any claim or dispute between You and Yellojobs that arises in whole or in part from the Yellojobs Site shall be decided exclusively by a court of competent jurisdiction located in Delaware. These Terms, together with the Privacy Policy and any other legal terms published by Yellojobs on the Yellojobs Site, shall constitute the entire agreement between You and Yellojobs concerning the Yellojobs Site. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Yellojobs' failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by You, but may be assigned by Yellojobs without restriction.
